In practice, this means the larger and more complex the estate, the higher the attorney's fees.

For a straightforward probate matter — a single property, a valid will, and no disputes among beneficiaries — attorney's fees typically range from 3% to 5% of the gross value of the estate. For a modest property valued at J$10 million (approximately USD $65,000), this could mean attorney's fees of J$300,000 to J$500,000.

Court and Government Fees

Beyond attorney's fees, there are several court and government charges involved in the probate process. These include court filing fees for the probate application at the Supreme Court, stamp duty on the Grant of Probate or Letters of Administration, and registration fees at the National Land Agency when the title is eventually transferred to the beneficiary or beneficiaries.

These charges are separate from attorney's fees and are paid directly to the relevant government agencies. A good attorney will give you a clear estimate of these costs upfront.

Additional Costs to Anticipate

Depending on the specifics of the estate, there may be additional costs. If a property survey is required — for example, if boundaries are unclear or the land needs to be subdivided — this is an additional expense.
